《当下小学教师惩戒权的行使困境及对策研究》文献综述

摘要：近年来，越来越多的专家学者关注到教师是否应行使惩戒权这一热点问题，国内外的学者对教师惩戒权进行了多方面、多角度、深层次的探讨并为教师惩戒权的研究奠定了扎实的理论基础。本文主要从教师惩戒权的概念辨析、性质界定，教师惩戒权合理性、合法性的论证，教师惩戒权的实施方式以及教师行使惩戒权的困境及对策等四个层面对前人的研究成果进行归纳评述，明确前人研究的大致方向，总结当前研究中存在的不足之处，为进一步的研究提供借鉴意义。

Abstract:In recent years, more and more experts and scholars have paid attention to the hot issue of whether teachers should exercise their disciplinary powers. Scholars at home and abroad have conducted multiple, multi-angle and in-depth discussions on the teacherrsquo;s disciplinary power, and laid a solid theoretical foundation for the research on the disciplinary power of teachers.This paper mainly analyzes the predecessorrsquo;s research results from four levels: the conception and nature of the teacherrsquo;s disciplinary power, the rationality and legitimacy of the teacherrsquo;s disciplinary power, the implementation of the teacherrsquo;s disciplinary power, and the difficulties and countermeasures of the teacherrsquo;s exercise of the disciplinary power. Summarize and comment, clarify the general direction of previous research, summarize the deficiencies in current research, and provide reference for further research.

国内外学者对于教师惩戒权的研究成果比较丰富，据笔者搜集到的资料，前人文献资料呈现以下几个方面的特点：首先，研究文献的数量呈现总体上升，平稳增长的趋势；其次，研究的内容由单一走向多元，逐渐深入，从教师惩戒权概念辨析、性质界定到教师使用惩戒权的合理、合法性的论证以及教师惩戒权的实施方式，从教师惩戒权在教育实践中的使用困境到教育实践中合理合法使用教师惩戒权的对策；最后，教师惩戒权的研究人员的范围逐渐扩大，由一开始的教育教学的研究学者和教育学专家到一些一线教师再到一些法律研究学者等。通过对文献的阅读、整理和分析，从内容的维度上进行简要归纳，笔者把国内外学者对教师惩戒权的研究分为教师惩戒权的概念辨析、性质界定，教师惩戒权合理性、合法性的论证，教师惩戒权的实施方式以及教师行使惩戒权的困境及对策四个层面。

一，关于教师惩戒权的相关概念辨析、性质界定

（一）、关于教师惩戒权的相关概念辨析

学者普遍认为，要合理地使用教师惩戒权，身为教师必须认识教育惩戒的内涵，厘清惩戒、惩罚以及体罚这三者的定义，将其区分开来。首先，在对惩戒的含义的理解上，惩，即处罚；戒，即警戒。也就是通过处罚的手段来达到警戒学生的目的。可见，惩只是手段，戒才是目的。作为同一过程的手段和目的，惩和戒是相辅相成、不可分割的。[1]
